The terms “Poulanker,” “we,” “us,” and “our” refer to Poulanker. Poulanker operates this online store and website, including the related information, content, features, tools, products, and services offered to customers (collectively, the “Services”).

Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with the policies referenced in them, explain your rights and responsibilities when accessing or using the Services.

We do not guarantee that every product or variation will remain available.

When you place an order, you are making an offer to purchase the selected products subject to these Terms and our other applicable policies.

An automated order confirmation acknowledges that we received your order but does not necessarily mean that the order has been finally accepted.

Poulanker may accept, review, decline, or cancel an order when reasonably necessary, including when:

Payment cannot be authorized
Billing or delivery information is incomplete or inaccurate
A product is unavailable
A pricing or product information error has occurred
The transaction is flagged by fraud prevention or security tools
We suspect unauthorized, fraudulent, abusive, or unlawful activity
The order cannot be fulfilled as submitted

We will attempt to notify you using the email address or phone number provided with the order if an order is changed, declined, or canceled.

If payment has already been captured for a canceled order, the applicable amount will be returned to the original payment method.

Please review your order carefully before submitting it. If you need to request a change or cancellation, contact us as soon as possible.

We will attempt to accommodate requests when possible, but we cannot guarantee that an order can be changed or canceled after it has entered processing or has been shipped.

Returns and exchanges are handled according to our Return & Refund Policy.

You represent that products purchased from Poulanker are intended for personal or household use and not for unauthorized commercial resale or export.

Section 4 – Prices, Payments, and Billing

All prices displayed on our website are listed in United States Dollars (USD) unless otherwise stated.

Prices, discounts, offers, and promotions may change without notice. The price charged will be the price displayed when your order is submitted, subject to the correction of genuine errors as described in these Terms.

The applicable product price, discounts, taxes, and other charges collected by Poulanker will be displayed during checkout before you complete your purchase.

Poulanker offers free standard shipping on all orders delivered within the United States, with no minimum order value.

We do not impose undisclosed shipping or handling fees after checkout.

Promotions may be subject to separate terms, including eligibility requirements, expiration dates, product restrictions, or limits on use. If separate promotion terms conflict with these Terms, the promotion-specific terms will control regarding that promotion.

You agree to provide accurate and complete purchase, billing, payment, and account information.

You represent that:

You are authorized to use the payment method selected
The payment information provided is accurate
The charges associated with the order will be honored by your payment provider
You will pay the total amount displayed and authorized during checkout

Available payment methods are displayed during checkout and are further described in our Payment Policy.

Full payment card credentials are handled through Shopify and supported payment providers. Poulanker does not directly store complete credit card or debit card numbers on its own website servers.

Section 5 – Shipping, Fulfillment, and Delivery

Poulanker currently ships to delivery addresses within the United States.

Orders are normally processed within 1–3 business days, Monday through Friday. After shipment, estimated transit time is 6–9 business days, Monday through Friday.

The total estimated delivery time is therefore 7–12 business days.

Poulanker works with third-party fulfillment and logistics providers. Depending on product availability and fulfillment requirements, an order may be dispatched from a facility located inside or outside the United States.

Our Pennsylvania business and correspondence address should not be understood as the shipping origin for every order.

Delivery times are estimates and are not guaranteed. Delivery may be affected by carrier interruptions, severe weather, public holidays, high shipping volume, inaccurate address information, or other circumstances outside our reasonable control.

We are not responsible for delays caused solely by carriers or events outside our reasonable control. However, we will provide reasonable assistance if a shipment appears to be delayed, lost, damaged, or incorrectly delivered.

Title and risk of loss will transfer only as permitted by applicable law. Nothing in these Terms excludes or limits any responsibility that cannot lawfully be excluded.

Shopify’s name, logo, product names, and branding belong to Shopify. Other names and trademarks displayed through the Services belong to their respective owners.

We do not necessarily monitor or control these third-party tools. Unless otherwise stated, access to optional tools is provided on an “as is” and “as available” basis.

Your use of an optional third-party tool is subject to the applicable provider’s terms and privacy policy.

We may introduce new website features, tools, or resources in the future. Unless separate terms are provided, those features will be considered part of the Services and will be subject to these Terms.

Poulanker is powered by Shopify, which enables us to provide the Services to you.

However, purchases made through our store are transactions directly between you and Poulanker.

Shopify is not the seller of products offered by Poulanker and is not responsible for the sales relationship between you and Poulanker, including injury, loss, or damage resulting from products purchased from Poulanker, except to the extent Shopify is independently responsible under applicable law.

To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising solely from your purchase transaction with Poulanker.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. IN THOSE JURISDICTIONS, THE EXCLUSIONS ABOVE APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

Nothing in these Terms excludes or limits any statutory warranty, consumer guarantee, return right, refund right, or other consumer protection that cannot legally be excluded.

Section 17 – Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, POULANKER AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM ACCESS TO OR USE OF THE SERVICES.

This limitation applies regardless of whether the claim is based on contract, negligence, tort, strict liability, or another legal theory and even if the possibility of such damage was disclosed.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury caused by negligence, violation of non-waivable consumer rights, or any other liability that cannot be excluded under applicable law.

Where liability cannot be fully excluded, it will be limited only to the maximum extent permitted by applicable law.

Nothing in this section excludes representations or rights that cannot legally be excluded.

These Terms and any separate agreement through which Poulanker provides Services will be governed by the laws of the Commonwealth of Pennsylvania and applicable federal laws of the United States, without regard to conflict-of-law principles.

Subject to any mandatory consumer protection or jurisdictional rights, disputes relating to these Terms or the Services will be brought before a state or federal court with appropriate jurisdiction in Pennsylvania.

Nothing in this section prevents a consumer from relying on mandatory rights or remedies available under the laws of their place of residence when those rights cannot legally be waived.
